Decision-Making Responsibility & Parenting Time

When determining child custody, Ontario courts prioritize the best interests of the child under the Children’s Law Reform Act.

  • Decision-Making Responsibility: The authority to make significant decisions about the child’s upbringing, including education, healthcare, and religion. This can be sole (one parent) or joint (both parents).
  • Parenting Time: The time each parent or guardian spends with the child, ensuring a meaningful relationship is maintained.

Child and Spousal Support

Child Support

Child support is a legal obligation to ensure the financial well-being of a child. The amount is determined using the Federal Child Support Guidelines, based on the paying parent’s income and the number of children.

  • Length of the marriage
  • Roles of each spouse during the marriage
  • Financial needs and earning capacity of both parties

While the Spousal Support Advisory Guidelines offer recommendations, the court ultimately decides on the amount and duration.

Property Division

Under Ontario’s Family Law Act, property acquired during the marriage and still in possession at the time of separation is divided equally between spouses. Exceptions apply for gifts or inheritances received during the marriage.
